NOTICE: By redeeming this ticket , guests acknowledge that they are voluntarily participating in hazardous recreational activities and assume any and all risk. The City of Palmdale is not responsible for injuries sustained from use of city facilities. Photographers employed by the City periodically visit our program sites and take photos of participants enrolled in our programs and using City facilities. These photos may be used for promotional purposes in City publications. If applicable, digital photo will be taken of the participant for use on ID card.
GENERAL RELEASE, WAIVER, AND ASSUMPTION OF RISK: I am fully aware and understand the potential risk involved with my or my child’s participation in this activity. Dangers could include, but are not limited to cuts, broken bones and other debilitating or permanent physical and emotional injury, damage to personal property, or death. I understand that equipment, if any, which may be provided for Participant’s protection may be inadequate to prevent serious injury. I also understand that there are potential risks of which I may not presently be aware.
Nevertheless, I acknowledge that I voluntarily elect to participate, or allow my child to participate (hereinafter either is “Participant”), in this program. I hereby agree to assume all risk of injury, damage to persons and property, or death and to hold the City, its elected and appointed officials, officers, employees, agents, and volunteers harmless form any liability for any injuries, or claim for damage, damage to goods, or death that may arise in connection with participation in this program. This Release, Waiver and Assumption of Risk (“Release”) also pertains to any actions of the City, its elected and appointed officials, officers, employees, agents, and volunteers (excepting only the sole negligence or willful misconduct of the City) which may have caused or contributed to the injury, damage, or death. This Release shall be binding upon my heirs, executors, administrators, successors, assigns, and dependents as well as myself. I allow Participant to participate freely and voluntarily in this activity and expressly assume all the risk of this activity. In the event of illness, or medical emergency, I authorize and consent to the City, and its agents and employees, to provide, administer, initiate, or obtain any necessary medical treatment for Participant. I hereby agree to assume all risk of injury, damage, or death, and to release, forever discharge and hold the City, its elected and appointed officials, officers, employees, agents, and volunteers harmless from any liability for any injuries, or claim for damage, or death that may arise as a result of medical treatment provided to Participant.
I hereby agree to indemnify, defend and hold harmless the City, and its elected and appointed officials, officers, employees, agents and volunteers, from any and all loss, liability, damage or cost they may incur due to any injury, damage, death or claims arising from Participant’s presence in, upon or about City premises or facilities or equipment or participation in the activity, whether by City’s negligence, Participant’s negligence, another participant’s negligence, or otherwise.
I, on behalf of Participant, hereby grant and convey to the City all right, title and interest in any and all photographs, images, video or audio recordings of Participant or likeness or voice made by the City in connection with the Participant’s involvement in the activity, including, but not limited to royalties, proceeds, or other benefits derived from such photographs or recordings.
Participant expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of California and that this Release shall be governed by and interpreted in accordance with the laws of the State of California. I agree that in the event any clause or provision of this Release is deemed invalid, the enforceability of the remaining provisions of this Release shall not be affected.
Participants acknowledge the risks, including communicable diseases, illnesses, and viruses, including, but not limited to, COVID-19. For groups, parties, and buyouts.
For Group, Party, Cabana, or Buyout Reservations
As the host or hostess you are required to ensure that your party guests are advised of the park rules and that they understand the operation of each ride and or attraction. Please read and instruct your guests to read all park rules posted at the main gate and each attraction.
In consideration of me and my minor and or adult guests (“Invitees”) being allowed to reserve and use the water park and other public facilities at DryTown Water Park (“Facilities”) for a reservation/booking, and to the fullest extent permitted by law, I hereby waive, release, signed and discharge in advance on behalf of myself and my Invitees, any and all claims and causes of action for damages for death, personal injury, and or property damage which I or any of my invitees may have or which may have hereafter accrue to any of us or any of our heirs, assigns, or other successors in interest against the City of Palmdale, its elected officials, officers, employees, volunteers, and/or agents (“Releases”), as a result of being allowed to reserve and or use any of the facilities. This Waiver is intended to release, in advance, the release from all liability under any theory, even if arising out of their active or passive negligence, but not gross negligence or willful misconduct.
I and my Invitees fully understand the nature of DryTown Water Park, and further understand and agree that serious accidents may occasionally occur while utilizing the Facilities, including any required transportation to and from the Facilities, and that users of the Facilities may sustain fatal or serious personal injuries and or property damage as a consequence of thereof. Knowing these risks, and having full knowledge of my and my Invitees’ physical limitations I nevertheless expressly agree to assume those risks and hold each of the Releases free and harmless with respect to any liabilities for such injuries, images, and/or death. I and my Invitees further understand and agree that this Waiver is binding on us and all of our heirs, assigns, and other successors in interest. I further expressly authorized the provision of emergency medical aid to me and/or my Invitees if needed and I agree that this Waiver shall apply to any such treatment.
I further agree to indemnify, defend, and hold each of the Releasees free and harmless, with respect to all claims and liabilities asserted by any person, including any of the Releasees, for damages, losses, and/or injuries, arising out of or in any way connected with my or my Invitees’ reservation and/or use of the Facilities including, but not limited to, any transportationin front of Facilities, to the fullest extent permitted by law. I accept full responsibility and agree to promptly pay all costs to repair and/or replace any property of the Releasees that are damaged by me or my Invitee.
I understand and agree that in the absence of this Waiver the City of Palmdale would not provide the opportunity for me to reserve the use of Facilities or other recreational activities or services described. By accepting this admission, Participant (for itself,its minor children, and invitees) acknowledges, understands, and agrees that they are assuming all risk and liabilities for potential injury arising out of the activity associated with this admission. Participant hereby waives any and all claims against the City.
The ticket purchaser or host/hostess also certifies under penalty of perjury that they are at least eighteen (18) years of age or older and understand that providing false information may result in cancellation of my purchase without a refund. Participant shall also comply with the Terms and Conditions found at www.[drytownwaterpark].com.
All Season Pass(es) and ticket sales are final, refunds will not be issued. A valid ID and payment card used to purchase online products may be asked for by staff for verification before park admission.
